Will Disputes & Contentious Probate

Contentious Probate refers to any form of dispute over the administration of an estate. These disputes often arise when there is disagreement over the interpretation of a Will, the value of the assets or a disagreement between the Executors or Beneficiaries.

A key part of the role of an Executor or Administrator is to ensure that the deceased’s true and final wishes are carried out. If you feel that your loved one’s true wishes are not being followed through – perhaps because there is an error in the Will or the estate is being mismanaged – you should consider obtaining advice from a Contentious Probate Solicitor in order to raise a claim.

Will Disputes

Will Disputes are the most common form of Contentious Probate.

A Will might be challenged due to one of the following reasons:

  • Lack of mental capacity
  • Undue Influence
  • Fraud
  • Lack of knowledge of the contents of the Will
  • Lack of approval of the assets in the Will
  • Lack of due execution of the Will

You do not need to be a Beneficiary or Executor under the Will in order to make a claim. You may have been promised an inheritance by the deceased, disinherited from the estate, a relative to the deceased or affected by the Will or any previous Will.

Further to this, if you feel that the Will does not provide reasonable financial provision and you are a relative or dependant of the deceased, you can make a claim under the Inheritance (Provision for Family and Dependants) Act 1975.
