Introduction

David has over 35 years experience in all aspects of Civil Litigation, Criminal and Matrimonial matters, Dispute Resolution and Commercial Debt Recovery.

During his legal career, he has dealt with all aspects of Commercial Litigation, including breach of contract, boundary disputes and Landlord and Tenant matters and more recently disputes relating to franchise agreements.  He has engaged in High Value Litigation in the Royal Courts of Justice in London and in the Chancery and Technology and Construction Courts.

He has acted in Defendant Medical Negligence cases involving sums in excess of £4,000,000 and has acted in Personal Injury and Employers Liability Claims for both Claimant and Defendant.

David also has extensive experience in all types of Matrimonial matters.  He specialises in high-value divorce cases and, together with a team of experts, uses innovative solutions to protect the commercial interests of our business clients.

David has a highly disciplined and determined manner which helps achieve tailor-made solutions to protect and safeguard his clients' best interests and their long-term objectives.

High Value Commercial Litigation

David’s commercial experience extends to High Value Litigation in the High Court and in the Mercantile and Chancery Courts.  He has dealt with cases running into many, many thousands of pounds and has acted in substantial matters in the Technology and Construction Courts. David has handled complex commercial litigation cases involving multiple parties, one recently where he acted for eight defendants where the sum claimed was in excess £3,750,000.

Property

David advises in all types of property litigation in particular Landlord and Tenant, all aspects of contentious Chancery work including forfeiture, restrictive covenants, boundary disputes and adverse possession, mortgages, compulsory purchase and compensation and property-related professional negligence.

David’s recent caseload has included a trial for relief from a fraudulent forged transfer of land involving handwriting evidence and a claim against conveyancing solicitors due to their failure to advise upon restrictive covenants.

Construction

David has assisted clients in relation to building and engineering contracts, together with contractors’ and employers’ claims and professional negligence claims, arising from construction contracts.  David has considerable experience in Fast and Multi Track cases, involving all major forms of Contract, including contract disputes involving defect claims and claims for work done and materials supplied.

Commercial Dispute Resolution / ADR

David assists his Clients in exploring the alternatives to litigation, particular ADR in all its manifestations. He appreciates that there is a limit on time that a businessman can devote to the resolution of any dispute, including the amount of money that any businessman can afford, or wishes to spend on legal costs. David achieves the satisfactory resolution of disputes at both reasonable and proportionate expense.

Employment

David undertakes all aspects of employment work, including unfair dismissal and all forms of discrimination. He possesses a specialism in complex Sex and Disability Discrimination Claims and with a team of specialist Counsel, practices in all aspects of Employment Law. David acts for Applicants and Respondents and was recently involved in a substantial Disability Discrimination Claim for the Applicant and the Defence of a company client, against which claims had been brought for constructive and unfair dismissal.

Personal Injury

David has dealt with high value personal injury matters for both claimants and defendants. David has been involved in numerous six figure claims at the Royal Courts of Justice, including clinical negligence claims of £4 million plus, compensation for catastrophic injuries and seven figure claims for injuries sustained in birth asphyxia.

Crime

David is an experienced crime practitioner, acting in the most serious of matters with cases ranging from actual bodily harm to murder, serious sexual offences including incest, and for clients charged with offences of affray, robbery and substantial white collar fraud.

Family

David brings a sympathetic approach and sensitive manner to divorce and ancillary relief claims. He specialises in complex financial disputes and employs a clear, focused, reasoned and practical approach to high value matrimonial finance disputes. He has acted in cases involving  trusts and family companies. With a team of specialist barristers and forensic accountants, who can provide in depth attention and accountancy advice and support, David represents highly successful business clients.
Recent cases have involved clients with assets over £3 million.

Intellectual Property

David undertakes work concerned with the enforcement of UK domestic and European Community Intellectual Property Rights, Registered Trademarks, Passing Off, Copyright, Design Rights and Patents. David has recently acted for a “pop group” and succeeded in protecting their stage name.

Insolvency

David advises clients in insolvency disputes where high value litigation claims lead to insolvency proceedings and where insolvency overlaps with high value litigation in the High Court. He has assisted clients with bankruptcy annulment, acted for administrators and has obtained injunctive relief. He has pursued actions against directors personally to recover monies which have been taken out of an ailing Company.

Professional Negligence

David has acted in professional negligence claims brought against solicitors involving conveyancing disputes and ancillary relief claims.  He has successfully claimed damages where a professional advisor had failed to properly explain restrictive covenants and where a solicitor failed to up date assets, leading to a reduced settlement in an Ancillary Relief Claim.

Outside the law David, enjoys walking, fine wines and watching rugby, football, cricket and most sports.
